What is stamp duty on property in India? +
Stamp duty is a state government tax levied on property transactions to legally register the sale deed. It is calculated as a percentage of the property's market value or agreement value, whichever is higher, and must be paid before or at the time of registration. Rates vary by state, typically ranging from 3% to 7%. Along with stamp duty, buyers also pay registration charges (usually 1% of property value) to record the transaction with the sub-registrar's office. Without paying stamp duty and registering the sale deed, the property transfer is not legally valid and cannot be used as evidence of ownership in court.
Which state has the lowest stamp duty in India? +
Among major states, Jammu & Kashmir (3%) and Goa (3.5%) have some of the lowest stamp duty rates in India. Karnataka also offers a lower 3% rate for properties under ₹20 lakh. Most other states charge between 4% and 7%. Uttar Pradesh, Kerala, and Chandigarh are on the higher end at 6–7%. Actual cost also depends on registration charges, which typically add another 1–2% regardless of the state, plus any female-buyer or joint-ownership discounts that can lower the effective rate further. Always check your state's latest circular as rates are revised periodically.
Do women get a discount on stamp duty? +
Yes, many Indian states offer a 1–2% stamp duty discount when the property is registered solely in a woman's name, or jointly with another woman, to promote women's property ownership. States like Delhi (2% less), Haryana (2% less), Punjab (2% less), Himachal Pradesh (2% less), Maharashtra (1% less), Uttar Pradesh (1% less), and Rajasthan (1% less) offer this benefit. Some states, such as Karnataka, Tamil Nadu, Gujarat, and West Bengal, do not currently offer a female-buyer discount. Joint ownership with a male co-buyer usually does not qualify unless the woman is the primary or sole owner, so check your state's specific rule before registration.
Is GST applicable on stamp duty? +
No, GST is not applicable on stamp duty or registration charges since these are state government levies, not a supply of goods or services. However, GST at 5% (without input tax credit) is applicable on the purchase of under-construction residential property from a builder (1% for affordable housing), charged on the agreement value. Stamp duty and registration are calculated separately on the same property value. Ready-to-move-in or resale properties, where a completion certificate has already been issued, are exempt from GST entirely — only stamp duty and registration charges apply in that case.
